Terms of Service

1. Who we are and what this covers

Privio is software that lets you publish a document and collect electronic signatures on it. These Terms of Service form an agreement between you and Privio and apply whenever you use the service, whether you are signing a document or sending one.

Privio is not a law firm and does not provide legal advice. The documents you publish, the wording you choose and the way you rely on a signed copy are your responsibility.

2. Consent to sign electronically

Before a signature is recorded, the signer must tick a consent box confirming they agree to sign electronically and that their electronic signature is intended to be legally binding, to the same extent as a handwritten signature.

The moment consent is given is recorded with the signature. A signer who does not wish to sign electronically should not tick the box and should instead ask the sender for a paper copy.

3. Records and evidence

Each completed signature is stored with the signer's name, the drawn signature image, the date and time of signing, the document title and version, and a snapshot of the document exactly as it was presented at the time of signing.

Signed records are available only to the account that published the document. Privio does not sell, share or reuse signed documents.

We make records available for download as PDF so you can keep your own copies. You remain responsible for retaining copies for as long as your own legal or regulatory obligations require.

4. Minors and guardian signatures

Where a signer indicates they are under 18, a parent or legal guardian must provide their own name and signature. By co-signing, the parent or guardian confirms they have authority to agree on the minor's behalf.

5. Your responsibilities as a sender

You confirm that you have the right to publish the documents you upload, that the content is lawful, and that you will only invite people to sign where you have a legitimate reason to do so.

You must not use Privio to collect signatures by deception, to impersonate another organisation, or to distribute unlawful, harmful or infringing content. We may suspend an account that does.

6. Accounts, trials and billing

New accounts include a free trial period with full access. When the trial ends you may choose a paid plan; plan limits, including how many signatures and documents are included, are shown on the pricing page.

Payments are processed by our payment provider acting as merchant of record. Subscriptions renew automatically for the period you selected until cancelled, and cancellation takes effect at the end of the current period. Where a payment fails, access to paid features may be limited until the payment succeeds.

7. Availability and liability

We work to keep Privio available and accurate, but the service is provided "as is" without warranties of any kind. We do not guarantee that a given signed document will be accepted or enforced by any court, counterparty or regulator.

To the maximum extent permitted by law, our total liability arising out of or in connection with the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, lost profits, or loss of data.

8. Ending your use of the service

You may stop using Privio at any time and delete your documents and signed records from your vault. Deleting a record is permanent, so download anything you need to keep first.

We may end or suspend access where these terms are breached, or where required by law.

9. Changes and contact

We may update these terms as the service changes. Continued use after an update means you accept the revised terms.
